Gateroom and several pieces of land (11½a.) called the Stemps in the village and fields of Worthing in Broadwater, i.e. 1a. lying E. and W. in a field called the East Field [adjoining] on N. to land heretofore of Mr. Fairhall and on S. to land heretofore of Mr. Cooke, ½a. more thereof [adjoining] on N. to land heretofore of one Geering and on S. to lands heretofore of said Fairhall, 1a. in the Middle Field in the Gore Furlong lying N. and S. adjoining to lands heretofore of said Fairhall on E. and to lands heretofore of Robert Barker on W., 1a. in the Home Field in the Middle Furlong lying N. and S. adjoining to lands `heretofore Mrs. Flemings' on E., and `Fairhall's' on W., 2½a. in the Mead Furlong lying N. and S. [adjoining] on E. All the above properties in Worthing were heretofore in the tenure or occupation of William Monk and afterwards of Richard Jeffereys and now of Richard Hoar, were heretofore purchased by said Nicholas Roberts, mariner, decd., great-grandfather of said Nicholas Roberts, party hereto, of William Wade, rector of Broadwater, and w. Elizabeth, were devised to said Nicholas Roberts, party hereto, in the will of said Nicholas Roberts, gent., decd., his father, and by indentures of lease & release (the release being of even date with this deed) were conveyed by (a) to (b)
II. Parcel of meadow land or ground (3a.) in Westbourne, bounded to the lands formerly of Edward Palmer and now of [blank] on W., the highway leading from Westbourne to Chichester on S., the river on N., and the lands formerly of [blank] Dorrington esq., and now of [blank] on E., and in the tenure or occupation of Richard Cathery, and which by indentures of lease & release (the release being of even date with this deed) were conveyed by Nicholas Roberts, party hereto, to (c)
III. Messuage, late in the possession or occupation of said Nicholas Roberts, party hereto, standing upon a plot of ground in the said parish of Saint Bartholomew and heretofore purchased by said Nicholas Roberts, merchant, decd. grandfather of said Nicholas Roberts, party hereto, of Edward Gosden of the said parish of Saint Bartholomew, millwright, which plot of ground contains in length from N. to S. 104 feet and in breadth from E. to W. 62 feet, [and lies] between a messuage or dwellinghouse heretofore in occ. of John Grigg, afterwards of John Scott, since of George White and late of Phoebe Chitty, wid., and now in possession or occupation of said Nicholas Roberts, party hereto, and hereinafter described, on E., the Parsonage Field on S., a messuage heretofore of one Statfield afterwards of James Warrington and late of [blank] Dist, gent., on W., and the highway leading from Chichester to Fishbourne on N., and the malthouse, outbuildings and garden to the said messuage belonging and now used therewith
Property, as in 928, but now described as between the messuage, malthouse and garden (as above), and tenement late in occ. of John Holden [sic] on W. [sic] part
Covenant that (a) will levy a fine to (d), as to the properties in I to the use of (b), as to the property in II to the use of (c) and as to the properties in III to the use of such person and upon such trusts as (a) during their joint lives shall appoint, and in default of such appointment to the use of said Nicholas Roberts, party hereto, for life, then to the use of said Catharine for life, then to the use of the right heirs of said Nicholas Roberts
This fine to be levied to secure some provision of maintenance for Catharine, should she survive her husband, out of the properties in III, since by consenting to join in the fine she will be barred of her right of dower at common law in the properties in I and II
